Last updated:17/10/2026
Section 1 – Overview
Welcome to Nurovia, a division of Nurovia Group (Pty) Ltd. The terms "we", "us" and "our" refer to Nurovia, a division of Nurovia Group (Pty) Ltd. We operate this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Nurovia is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with the policies referred to in them (our Privacy Policy, Refund Policy and Shipping Policy), are our "Terms of Service" or "Terms". They describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights.
By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use our Services. Nothing in these Terms limits any rights you have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other law that cannot be limited by agreement.
Section 2 – Who We Are
- Business name: Nurovia, a division of Nurovia Group (Pty) Ltd
- Registration number: 2025/500497/07
- Physical address: 49 Central Street, Schornville, Qonce, Eastern Cape, 5601, South Africa

Section 3 – Access and Account
By agreeing to these Terms, you confirm that you are at least 18 years old, or that you are a minor who is using the Services with the consent and supervision of a parent or guardian. If you allow a minor to use the Services on your device, you are responsible for their use.
To use the Services, including browsing our online store or buying our products, you may be asked to provide information such as your email address and your billing, payment and shipping details. You confirm that all information you give us is correct, current and complete, and that you have the right to provide it.
You are responsible for keeping your account details secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.
Section 4 – Our Products
We have made every effort to show our products accurately. However, colours and product appearance may look different on your screen because of your device and its settings. Product sizes, weights and specifications are provided as a guide and may vary slightly.
We may change product descriptions, discontinue products, and limit the quantities we sell to any person, region or jurisdiction at any time, without affecting orders that have already been confirmed.
Section 5 – Orders
When you place an order, you are making an offer to buy. Your order is accepted only when we confirm it, and we must first receive and process your payment. We may decline an order for reasons such as stock availability, incorrect pricing, suspected fraud or an inability to deliver to your address. If we decline or cancel an order after you have paid, we will refund you in full.
Please check your order carefully before you submit it. If we are unable to accept or must change or cancel an order, we will try to contact you using the email address, billing address or phone number you gave us.
You can cancel or change an order within 24 hours of placing it, as long as it has not yet been processed for dispatch. Returns and cancellations after that are governed by Section 8 and our Refund Policy.
Your purchases must be for your own personal or household use and not for commercial resale or export.
Section 6 – Prices and Payment
All prices are shown in South African Rand (ZAR) and include VAT where we are required to charge it. Delivery is included in the price shown at checkout. The price you pay is the price in effect when you place your order, and it is shown in your order confirmation email.
Prices, discounts and promotions may change without notice, but this does not affect orders that have already been confirmed. Promotions may have their own terms. If a promotion's terms conflict with these Terms, the promotion's terms apply to that promotion.
If we discover a pricing or description error after you place an order, we will contact you and give you the choice of continuing with the order at the correct price or cancelling it for a full refund.
You agree to give us current, complete and accurate payment and account information, and to keep it up to date. You confirm that (i) the payment details you provide are true and complete, (ii) you are authorised to use the payment method, and (iii) you will pay all charges at the posted prices, including delivery fees and any applicable taxes.
Section 7 – Delivery
Orders are sent directly to you by our fulfilment partner. Delivery fees, processing times, delivery times and delivery areas are set out in our Shipping Policy. Delivery times are estimates and are not guaranteed, but we will do our best to meet them and will tell you promptly if there is a delay.
Risk in the goods passes to you when they are delivered to the address you gave us. If your order is lost or does not arrive, we will help resolve it as described in our Shipping Policy. Please give us a correct and complete delivery address and be available to receive your parcel.
Section 8 – Returns, Refunds and Cancellations
Our Refund Policy explains how returns, refunds and exchanges work and forms part of these Terms. In summary:
- You may cancel your order and return items, without giving a reason, within 7 days of receiving them. You are responsible for the cost of returning items, and we will refund the price of the returned items. Courier cost may be applied on returns.
- If an item is faulty, damaged or not what you ordered, we will cover the return cost and offer a replacement or a refund.
- Some items cannot be returned for hygiene, safety or legal reasons. These are listed in the Refund Policy.
Section 9 – Faulty Goods
We will supply goods that are of good quality, in good working order, and free of defects. If goods are faulty or unsafe, you have the right under the Consumer Protection Act to return them within 6 months of delivery and to choose between a repair, a replacement or a refund. Please contact us at info@nuroviavision.com with your order number and clear photos or video of the problem.
Section 10 – Intellectual Property
Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement of them, are owned by Nurovia (a division of Nurovia Group (Pty) Ltd), its affiliates or licensors, and are protected by intellectual property laws.
You may use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material on the Services without our prior written consent.
Except as expressly stated in these Terms, nothing gives you a licence or other right under any patent, trademark, copyright or other intellectual property of Nurovia, Shopify or any third party. All rights not expressly granted are reserved.
Nurovia's names, logos, product and service names, designs and slogans are trademarks of Nurovia or its affiliates or licensors. You must not use them without our written permission. Shopify's names, logos and designs are trademarks of Shopify. All other names, logos and designs on the Services belong to their respective owners.
Section 11 – Optional Tools
We may give you access to tools offered by third parties as part of the Services, which we do not monitor or control. These tools are provided "as is" and "as available", without any endorsement, and to the extent permitted by law we are not liable for your use of them. You should make sure you are familiar with and approve of the terms of the third party that provides each tool.
We may offer new features in future (including new tools and resources). Any new features become part of the Services and are subject to these Terms.
Section 12 – Third-Party Links
The Services may contain links to websites operated by third parties, including embedded third-party functionality. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. If you choose to leave the Services to visit these sites, you do so at your own risk. Please review the third party's policies and practices before you engage in any transaction. Complaints about third-party products or services should be directed to the third party.
Section 13 – Relationship with Shopify
Nurovia is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Nurovia. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Nurovia, including any injury, damage or loss resulting from purchased products and services. To the fullest extent permitted by law, you release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Nurovia.
Section 14 – Privacy
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's privacy policy. By using the Services, you confirm that you have read these policies. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your use of the Services. Information you submit may be transmitted to and shared with Shopify, our fulfilment partner and other third parties that may be located in countries other than where you live, in order to provide the Services to you.
Section 15 – Feedback
If you submit or send us any ideas, suggestions, reviews, proposals or other content (together, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use. For example, we may use this licence to operate, evaluate, improve and promote the Services.
You also confirm that (i) you own or have all necessary rights to your Feedback; (ii) you have told us about any compensation or incentives you received in connection with it; and (iii) it complies with these Terms.
We are not obliged (1) to keep your Feedback confidential, (2) to pay you for it, or (3) to respond to it. We may, but are not required to, monitor, edit or remove Feedback that we decide is unlawful, offensive, threatening, defamatory, pornographic, obscene or otherwise objectionable, or that violates anyone's intellectual property or these Terms.
Your Feedback must not violate any third party's rights (including copyright, trademark, privacy or personality rights), must not contain anything unlawful, abusive or obscene, and must not contain any computer virus or malware. You may not use a false email address, pretend to be someone else, or mislead us or others about where Feedback comes from. You are responsible for your Feedback and its accuracy, and we take no responsibility for Feedback posted by you or anyone else.
Section 16 – Errors, Inaccuracies and Omissions
Occasionally the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, delivery charges, transit times or availability. We may correct these at any time without notice. Section 6 explains what happens if an error affects an order you have already placed.
Section 17 – Prohibited Uses
You may use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly:
- (a) for any unlawful or malicious purpose;
- (b) to violate any international, national, provincial or local laws, regulations or ordinances;
- (c) to infringe our intellectual property rights or those of others;
- (d) to harass, abuse, insult, harm, defame, slander, disparage or intimidate any of our employees or any other person;
- (e) to transmit false or misleading information;
- (f) to send, knowingly receive, upload, download, use or re-use any material that does not comply with these Terms;
- (g) to transmit, or arrange the sending of, any advertising or promotional material, including "junk mail", "chain letters", "spam" or similar solicitation;
- (h) to impersonate or attempt to impersonate any other person or entity; or
- (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or that we decide may harm Nurovia, Shopify or users of the Services, or expose them to liability.
In addition, you agree not to:
- (a) upload or transmit viruses or other malicious code that may affect the functionality or operation of the Services;
- (b) reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services;
- (c) collect or track the personal information of others;
- (d) spam, phish, pharm or pretext the Services;
- (e) use any robot, spider, scraping, data-gathering or extraction tools, automatic devices or processes, AI tools (such as agentic AI), or automated or manual means to access the Services, except as permitted by Section 18; or
- (f) interfere with, bypass or circumvent the security or authorisation features, robot exclusion headers or other measures we use to restrict access to the Services.
We may suspend, disable or terminate your account at any time if we determine that you have violated any part of these Terms.
Section 18 – Agents
18.1 This section ("Agent Terms") applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with any of the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can be run on behalf of, or using, a person's device without direct supervision.
18.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 18.4 below. No Agent may access, use or interact with the Services if we have asked it to stop.
18.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.
18.4 Agents must:
- (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the Agent's name by including "Agent/[agent name]" in the request's user agent string;
- (ii) not conceal or obscure that any access, use or interaction is from an Agent, for example by (a) mimicking human behaviour and interaction patterns, or (b) completing or circumventing CAPTCHAs or other measures intended to tell computers apart from humans;
- (iii) respond truthfully to any question or prompt asking whether the interaction is coming from a human or a computer; and
- (iv) not circumvent or avoid any measure intended to block, limit, modify or control whether and how Agents access, use or interact with the Services.
Section 19 – Termination
We may end this agreement or your access to the Services (or any part of them) at any time. This does not affect orders that have already been confirmed and paid for, and you remain liable for any amounts due up to the date of termination.
The following sections continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy, and any other provisions that by their nature should continue.
Section 20 – Disclaimer
The information on or through the Services is provided for general information purposes. To the extent permitted by law, we do not guarantee that it is accurate, complete or useful, and any reliance you place on it is at your own risk.
To the extent permitted by law, the Services are provided "as is" and "as available", and we do not guarantee that your use of them will be uninterrupted, timely, secure or error-free.
This section does not limit or remove any right you have under the Consumer Protection Act or any other law, including your right to goods that are of good quality and free of defects.
Section 21 – Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NUROVIA, A DIVISION OF NUROVIA GROUP (PTY) LTD, AND ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS, AND THOSE OF SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL LOSS OR DAMAGE, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, WHETHER IN CONTRACT, DELICT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT BOUGHT THROUGH THEM.
Nothing in these Terms excludes or limits our liability for fraud, gross negligence, death or personal injury, or any liability that cannot be excluded or limited under South African law, including under the Consumer Protection Act.
Section 22 – Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Nurovia, a division of Nurovia Group (Pty) Ltd, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to a third party because of (1) your breach of these Terms or the documents they refer to, (2) your violation of any law or the rights of a third party, or (3) your misuse of the Services.
Section 23 – Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable part will be treated as removed from these Terms. This does not affect the validity and enforceability of the remaining provisions.
Section 24 – Waiver and Entire Agreement
If we do not exercise or enforce a right or provision of these Terms, that does not mean we have given it up. These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies or operating rules we post on this site, are the entire agreement between you and us and replace any earlier agreements, communications and proposals, whether oral or written.
Section 25 – Assignment
You may not transfer or assign these Terms, or any of your rights or obligations under them, without our prior written consent, and any attempt to do so is void. We may transfer or assign these Terms and our rights and obligations to another party, and we will let you know if that affects your rights.
Section 26 – Governing Law and Complaints
These Terms, and any separate agreement under which we provide you with Services, are governed by the laws of South Africa.
If you have a complaint, please contact us first at info@nuroviavision.com and we will try to resolve it quickly. You also have the right to approach the National Consumer Commission, an accredited consumer ombud or industry body, or the courts.
Section 27 – Headings
The headings in these Terms are for convenience only and do not limit or affect the meaning of the Terms.
Section 28 – Changes to These Terms
You can review the current version of these Terms at any time on this page. We may update or replace any part of them by posting the changes on our website, and the updated Terms will apply to orders placed after the update. It is your responsibility to check this page from time to time. If you keep using the Services after changes are posted, you accept those changes.
